          B. FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE ROAD MAINTENANCE MANAGEMENT BOARD
          I. Position and Functions of the Road Maintenance Management
          1. The Road Maintenance Management Board is a public service entity under the Son La Department of Construction. It is granted full autonomy in performing tasks, managing finances, organizational structure, and personnel in accordance with the Law on Public Employees and the autonomy mechanism for public service entities as stipulated in Government Decree No. 60/2021/ND-CP dated June 21, 2021.
          2. The Board has legal status, its own seal, and is entitled to open accounts at the State Treasury and commercial banks within the province to conduct transactions in accordance with the law.
          II. Duties and Powers of the Board
          1. The Board acts as a representative or carries out certain functions, duties, and powers of the Department of Construction in the state management of road maintenance for provincial and national roads assigned within Son La Province. This includes routine maintenance, disaster response, emergency and periodic repairs, and the establishment of road information and infrastructure asset databases for management purposes
         2. The Board performs tasks assigned by the Department of Construction in the management and maintenance of road infrastructure assets, protection of road land and safety corridors, and other duties as stipulated in the Law on Construction, the Law on Roads, the Law on Road Traffic Order and Safety, and related decrees and circulars. Specifically:
         a) Conduct road patrols on roads under direct management;
         b) Implement regulations on the management and protection of road infrastructure. Coordinate with functional departments of the Department of Construction, local authorities, and relevant agencies to manage and protect road land and handle safety corridor violations. Participate in clearance and enforcement actions against improper use of road infrastructure. Inspect and manage construction permits within road safety corridors;
         c) Conduct inspections, reviews, and propose annual maintenance plans;
         d) Carry out assigned tasks related to investment preparation for road infrastructure management and maintenance, including preparing and submitting for appraisal and approval technical-economic reports or road repair project proposals; preparing and submitting public service price proposals for regular maintenance of road infrastructure;
         e) Organize contractor selection and perform assigned duties related to contract signing with contractors responsible for management, maintenance, and operation of road works;
         f) Manage contracts, inspect, supervise, approve, and make payments within the authority delegated by the Department of Construction. Prepare and submit final settlements for completed maintenance projects;
         g) Handle recommendations from regular maintenance and operation units regarding damage, deterioration, incidents, potential risks, and safety issues related to road infrastructure;
         h) Organize and be on standby for disaster prevention and recovery in the road sector; ensure traffic safety; supervise contractors in addressing post-disaster recovery and other force majeure incidents. Coordinate and monitor the preparation of completion documents and submit them for approval; coordinate traffic rerouting plans when required by competent authorities;
         i) Manage and preserve materials and spare equipment warehouses for disaster recovery and other emergency situations;;
         k) Regularly update and provide road information and data; maintain records and report on the status of road infrastructure asset management and use; compile and update asset data;
         l) Exercise the rights and obligations of an Investor as authorized by the Department of Construction;
         m) Perform other tasks as assigned by the Director of the Department of Construction.
         3. Operating Funds: From project management expenses (within the allowable scope) and other lawful revenue sources as regulated.
         4. Facilities: Utilize facilities assigned by the Department of Construction at No. 06 Mai Dac Ban Street, Group 2, Quyet Thang Ward, Son La City, Son La Province.
         5. Working Relationships: The Board is under the direct and comprehensive leadership and supervision of the Director of the Department of Construction. It is also subject to state management by competent authorities as prescribed. The Board may actively coordinate with relevant agencies, organizations, and individuals to perform its duties.
          III. ORGANIZATIONAL STRUCTURE
         1. Leadership of the Board: Includes one Director and no more than two Deputy Directors   
          – The Director is responsible to the Director of the Department of Construction and to the law for all activities of the Board.
– The Deputy Directors assist the Director in certain areas and are responsible to the Director and the law for their assigned duties. In the Director’s absence, one Deputy Director may be authorized to operate the Board’s activities.
          2. Specialized Departments under the Board:
          2.1. Planning and General Affairs Department: Includes one Head of Department, one Deputy Head, and staff members according to their roles and job positions.
          2.2. Management and Maintenance Department: Includes one Head of Department, up to two Deputy Heads, and staff members as per their assigned responsibilities and job positions.
          – The Head of Department is overall in charge and responsible to the Board Director and the law for all departmental activities.
          – The Deputy Heads assist the Head and are accountable to the Head and the Board leadership for assigned tasks.
          – The appointment and dismissal of Heads and Deputy Heads of specialized departments are decided by the Board Director after receiving written approval from the Department of Construction.
